    Inventé à l'ère industrielle pour protéger des inventions matérielles, le droit des brevets n'a pas su s'adapter aux inventions industrielles abstraites. Les logiciels, par exemple, ont été exclus de la brevetabilité en raison de leur manque de matérialité. Une telle façon de justifier cette exclusion étant économiquement absurde, il aurait fallu adapter le droit international des brevets à l'émergence du "monde virtuel". Cela n'est pas encore fait. Inadapté au monde moderne de l'innovation, le système international des brevets est entré dans une phase de déclin.
