Legal Knowledge and Information Systems: JURIX 2006: The Nineteenth Annual Conference - Volume 152 Frontiers in Artificial Intelligence and Applications
Authors: T.M. Van Engers; Editors. Hardcover, 192 pagesPublisher: IOS Press Publication Date: 2006-11-01 Reviews :

This volume contains the Proceedings of the Nineteenth JURIX Conference on Legal Knowledge and Information Systems (JURIX 2006). The large number of submissions shows that the interdisciplinary community is still growing and active. This volume again covers a broad range of topics. Argumentation is central to legal reasoning and therefore it is no surprise that researchers have focused on computational theories of argumentation. In this book four papers are dedicated to this topic. Typical to the legal field is the use of written knowledge sources, especially legal sources. These have been subject to AI & Law research for a long time, varying from structuring and accessing legal sources to using natural language processing techniques in order to determine the semantics of language utterances. This book contains four papers on legal sources. Central to AI and consequently to AI & Law are knowledge representation and ontologies. The latter especially are becoming more and more popular due to developments in Semantic Web research. Four papers on these topics can be read in this book. Three papers are included on applications and last but not least, the book contains four short papers on various topics....

ICT Law and Internationalisation - A Survey of Government Views (Law and Electronic Commerce Volume 10)
Authors: Bert-Jaap Koops. Corien Prins. Hielke Hijmans. Hardcover, 224 pagesPublisher: Kluwer Law International Publication Date: 2000-11-08 Edition: 1 Reviews :

Legal problems abound in the information society. Electronic commerce, copyright, privacy, illegal and harmful content, taxes, wiretapping governments face an enormous challenge to meet the advent of the Internet and ICT with a flexible, up-to-date, and adequate legal framework. Yet one aspect makes this challenge even more daunting: internationalization. Law is still to a great extent based on nation states, but the information society is above all a borderless and global society. Territoriality and national sovereignty clash with the need for a global approach to address ICT-law issues. Should states leave everything to the global market, or should they intervene to protect vital national interests? If they create regulations, should these reflect the rules of the physical world? How can one enforce national rules in a world where acts take place somewhere in Cyberspace? This text presents the positions on these issues of the governments of the Netherlands, Germany, France, the UK, and the US, as well as of international organisations. How do they think about co-regulation, law enforcement, harmonization, international co-operation, and alternative dispute resolution? How do they deal with applicable law and online contracts, privacy, international liability of Internet providers, and electronic signatures? What are the implications of the European Electronic Commerce Directive and the draft Crime in Cyberspace convention? Any legal framework that is to fit the global information society must take into account internationalization. This volume shows to what extent governments are meeting this challenge....

Information Technology And Arbitration: A Practioner's Guide
Authors: Thomas Schultz. Paperback, 264 pagesPublisher: Kluwer Law International Publication Date: 2006-07-19 Reviews :

This is not another book about online dispute resolution (ODR). Rather, it is about how various information technology (IT) solutions may be put to good use in traditional arbitral proceedings. Because IT tools can reduce costs and time radically by accelerating the arbitral process, the trend toward more and more use of such tools in arbitral proceedings is unstoppable. For arbitration professionals, be they arbitrators or counsel, this book brings the landscape of this changed practice into clear focus, dispersing mists of confusion and clarifying the choices they will inevitably be called upon to make. In this first handbook on what is likely to become one of tomorrow's incontrovertible topics in the field of arbitration, a well-known expert in ODR guides the reader through the reasons to use IT and its practicalities, the choices made by the prevalent arbitration institutions in this regard, and the legal limits to the use of such technologies. His powerful 'toolbox' includes a wealth of practice guidelines, drafting suggestions for arbitrators or parties wishing to use IT, and checklists and reminders to be used in practice. Among the efficiency-promoting IT tools thoroughly explained are the following: case management websites; videoconferencing; live notes; ODR platforms as ready-to-use solutions; online filing; and e-mail. The presentation focuses on the IT systems developed by major arbitral institutions like the International Chamber of Commerce (ICC), the American Arbitration Association (AAA), and the World Intellectual Property Organization (WIPO), with detailed guidance through their case management websites, virtual case rooms, extranets, and other IT tools allowing multiparty communications. The book's highly accessible text - complete with anecdotes, vividly depicted examples, and interesting background information - is backed with great knowledge and expertise in the uses of IT in law practice, so the reader is assured of gaining confident awareness of the easy advantages to grasp and the stumbling blocks to avoid as he or she proceeds. This is a book in which anyone involved in an arbitration, or even likely to be, will discover great benefit....

The Information Society: Emerging Landscapes: IFIP International Conference on Landscapes of ICT and Social Accountability, Turku, Finland, June 27-29, ... Federation for Information Processing)
Authors: Hardcover, 354 pagesPublisher: Springer Publication Date: 2006-01-26 Edition: 1 Reviews :
In 1990, members of IFIP Working Group 9.2 were instrumental in producing one of the first books to describe the ‘Landscape’ of the new phenomena created by the uptake of computerization – the so-called Information Society. Ten years later, at the annual Namur meeting of its Working Group in January 2000, a proposal was made to produce a second book and the brainstorming began. In the time that had passed, the developments in computer technology had brought the Internet within reach of ordinary citizens, and the World Wide Web had spawned a new ‘e-industry’. The landscape of the information society had changed dramatically, and it continues to change at a breathtaking pace. This book is the result of those discussions, culminating with the "Landscapes" Conference held at Turku University, Finland, in July 2005. The themes chosen for the conference – philosophy, ethics and sociological aspects, culture and education; social aspects; politics and regulation; economics and work; technology and emerging technologies – represent many of the perspectives from which to view this landscape. The papers illustrate the diverse impacts of the information society and the changing paradigms within education, law, health care, the workplace and on future societal infrastructures through research initiatives and the development of new technologies. In this book, IFIP WG9.2 has attempted to capture the new ‘emerging landscape’ of the Information Society. A picture of profound technological and social change emerges from this holistic approach. It offers a key to understanding the ramifications of computer technologies within the information society, and of the social accountability of all those who work with and are affected by them. ...

Real Law@Virtual Space: Communication Regulation in Cyberspace (Hampton Press Communication)
Authors: Paperback, 381 pagesPublisher: Hampton Press Publication Date: 2005-03-15 Edition: 2nd Reviews :

The first edition of Real Law @ Virtual Space explored the historical and ever-changing aspects of the regulation of communication in cyberspace. Much has changed in the Intervening four years as legislators, service providers, consumers and courts grapple with fundamental principles and nuances of regulation, particularly as daily social, political, economic and commercial life moves increasingly into cyberspace. The second edition of this volume addresses the foundation of regulation while reporting on the most current evolving regulatory measures. The technology of communication challenges developments in applicable laws governing rights of privacy, free expression, and liability. Specifically, developments in such areas as obscenity, libel, copyright and intellectual property, linking liability, and cybercrime are considered. In addition, the volume examines existing law and explores the issues that will require legislative and judicial attention in the near future as the law develops and focuses upon communicative rights and liabilities. The volume focuses on developments within the United States, but it also deals with the challenges to jurisdiction in transnational cyberspace....
