In November 1999, at the height of the e-commerce gold rush, a hearing in a Los Angeles courtroom wrenched open the fault lines that ran through the Internet.

On one side was eToys.com, the billion-dollar darling of Wall Street and the brainchild of Toby Lenk, one of the hottest entrepreneurs of his generation. On the other side was etoy, a group of cutting-edge European artists, hungry for fame, who used the Internet as their canvas. The struggle between them became known as the Toywar. At stake were liberty, justice, and the speedy delivery of toys.

Leaving Reality Behind is the definitive and gripping account of a battle that shook the Internet and sharply focused attention on the conflict at its very core: Was the Internet created as entertainment for the many or for the exponential profit of the few? This riveting case reveals the larger story behind the first decade of the Web -- the conflict surrounding its creation; the invention of search engines; the battle over domain names, and the discovery of the glittering promise of online retailing -- when the capital markets left reality behind.

As the real-life thriller of the Toywar came to its climax, the online world went into meltdown. There remained one crucial question: After the Internet crash of 2000, which would prove more enduring -- an eight-billion-dollar corporation built by America's brightest businessmen or a chaotic art project created by a group of artsy rebels from Europe?

Regulating Internet Abuses: Invasion of Privacy
Authors:
Hardcover, 228 pages
Publisher: Kluwer Law International
Publication Date: 2007-07-26

Reviews :

Spam unsolicited, unwanted commercial communication, especially in bulk form is increasingly included in the areas of concern and regulation of governments worldwide.
Unfortunately, this recognized and exponentially growing menace has not yet met its regulatory match. Piecemeal controls, lack of international cooperation, and the absence of an overall policy on combating patently intrusive and unwanted messages in all channels of communication hamper the struggle.

Regulating Internet Abuses contains eleven national reports, together with a general report, on this major problem that is presently burdening and distorting communications through the Internet. Most of the reports were presented at the XVIIth Congress of the International Academy of Comparative Law held at Utrecht, the Netherlands on July 19, 2006. The authors have had the opportunity to revise and update their texts before they were submitted here for publication. The national reports are from Denmark, France, Germany, Greece, Italy, Poland, Spain, South Africa, Switzerland, the United Kingdom, and the United States.

Starting from some common assumptions including respect for freedom of expression; emphasis on unsolicited, bulk , automated messages to strangers; and non-interference with the normal use of the Internet the contributors set out to tackle spammer elusiveness and the difficulties of cross-border coordination that plague this
field. Among the broadly conceived legal responses they consider are the following:
making spam illegal; empowering the user to avoid and repel spam; laws governing confidentiality of personal data; application of unfair competition laws; and conscripting the service providers to block spam in its tracks through a variety of controls.

The reports provide documentation and analysis of the various ways in which these approaches have been used, or can be used, in legislation and case law in a variety of
national and international fora.Workers in all fields of communications, from technologists to legal practitioners and academics to administrative policymakers, will benefit enormously from these syntheses and insights....

Which state has and should have the right and power to regulate which site and online event? Who can apply their defamation or contract law, obscenity standards, gambling or banking regulation, pharmaceutical licensing requirements or hate speech prohibitions to any particular Internet activity? Traditionally, transnational activity has been 'shared out' between national sovereigns with the aid of location-centric rules and these can be adjusted to the transnational Internet. But can these allocation rules be stretched indefinitely and what are the costs for online actors and for states themselves of squeezing global online activity into nation-state law? Does the future of online regulation lie in global legal harmonization or is it a cyberspace that increasingly mirrors the national borders of the offline world? This book offers some uncomfortable insights into one of the most important debates on Internet governance....

Paperback, 600 pages
Publisher: Oxford University Press, USA

Reviews :

Computing technology gives rise to unique legal problems which are not resolvable by applying existing legal principles. The developing law which seeks to resolve these problems is at the heart of the latest edition of this book, now established as a standard text on computer and information technology law for both students and practitioners. Topics covered range from contractual matters and intellectual property protection to electronic commerce, data protection and liability of internet service providers. Competition law issues are integrated into the various commercial sections as they arise to indicate their interaction with information technology law.
The new edition of this established book has been completely updated to cover the significant changes in information technology law since the last edition, which have included the landmark Supreme Court decision in MGM v Grokster. The book has also been restructured for ease of reference into sections dedicated to broader topics. These include: a section on commercial exploitation of information technology products and services, with a new chapter on software development and licensing; an expanded section on online commerce, as opposed to e-commerce alone, covering both e-commerce transactions, and online intermediaries; and a section devoted to intellectual property issues in information technology law, with a new chapter treating online use of trade marks, and domain names....

Investigating Child Exploitation and Pornography: The Internet, Law and Forensic Science
Authors: Monique Ferraro. Eoghan Casey.
Hardcover, 320 pages
Publisher: Academic Press
Publication Date: 2004-10-21
Edition: 1

Reviews :

Crime scenes associated with child sexual exploitation and trafficking in child pornography were once limited to physical locations such as school playgrounds, church vestibules, trusted neighbors' homes, camping trips and seedy darkly lit back rooms of adult bookstores. The explosion of Internet use has created a virtual hunting ground for sexual predators and has fueled a brisk, multi-billion dollar trade in the associated illicit material. Approximately half of the caseload in computer crimes units involves the computer assisted sexual exploitation of children. Despite the scale of this problem, or perhaps because of it, there are no published resources that bring together the complex mingling of disciplines and expertise required to put together a computer assisted child exploitation case.
This work fills this void, providing police, prosecutors and forensic examiners with the historical, legal, technical, and social background for the laws prohibiting child exploitation, in particular, child pornography. The book will become an indispensable resource for those involved in the investigation, prosecution and study of computer-assisted child sexual exploitation.

The book provides a history of child exploitation cases and studies, outlining the roles of technology in this type of crime and the evidence they can contain, and documenting new research performed by the authors. It details how successful undercover Internet operations are conducted, how the associated evidence is collected, and how to use the evidence to locate and apprehend the offender. The heart of this work is a legal section, detailing all of the legal issues that arise in Internet child exploitation cases. A forensic examination section presents evidentiary issues from a technical perspective and describes how to conduct a forensic examination of digital evidence gathered in the investigative and probative stages of a child exploitation case.
Citations to related documents are provided for readers who want to learn more about certain issues. Actual case examples from computer assisted child exploitation cases are explored, at all times protecting the privacy of the victims while providing enough detail to educate the reader.
In addition to providing guidance on the technical and legal aspects of child exploitation investigations, this work identifies and analyzes trends in this type of crime and helps readers understand the similarities and differences between child predators who take to the Internet and predators who do not. Data from the thirty Internet Crimes Against Children (ICAC) Task Forces are compiled and reported to provide a deeper understanding of the types of cases, types of offenders and the level of danger they pose to themselves, their victims, and investigating officers. Also, sex offender data from the Offices of Attorneys General in the United States and similar offices in foreign countries are gathered to increase the study sample size, establish controls, and expand the scope of the research to outside of the United States.

- The first comprehensive title in this subject area
- It will use real cases and examples of criminal behavior and the means to detect it.
- Provides guidelines for developing a Field Manual and a Checklist to supplement the investigation and legal process
- Establishes a reliable system and legal, procedural-backed protocol by which to conduct an online sexual investigation and collect evidence...

Reviews :

The common fallacy regarding cyberspace is that the Internet is a new jurisdiction, in which none of the existing rules and regulations apply. However, all the actors involved in an Internet transaction live in one or more existing jurisdictions, so rather than being unregulated, the Internet is arguably highly regulated. Worse, much of this law and regulation is contradictory and difficult, or impossible, to comply with. This book takes a global view of the fundamental legal issues raised by the advent of the Internet as an international communications mechanism. Legal and other materials are integrated to support the discussion of how technological, economic and political factors are shaping the law governing the Internet. Global trends in legal issues are addressed and the effectiveness of potential mechanisms for legal change that are applicable to Internet law are also examined. Of interest to students and practitioners in computer and electronic commerce law....

Secrets of Successful Web Sites
Authors: David Siegal.
Paperback, 320 pages
Publisher: Hayden
Publication Date: 1997-07-31

Reviews :

Much of the book consists of visual case studies that give information that most sites won't give out- what worked for them, why and exactly how. Readers learn the insider secrets of successful business planning, budgeting, and collaboration. Each case study explores both the client and developer point of view, so readers can see for themselves what works and what doesn't. This book gives clients everything they need to guarantee a successful site and gives Web developers everything they need to guarantee a successful Web business....

What does it feel like to create a major commercial Web site? And what do you have to do to make it succeed? David Siegel's new Secrets of Successful Web Sites gives us a close look at 15 high-profile projects and extracts the hard lessons that they can teach. Anyone embarking on a big development project, whether as a designer, producer, or client, will do well to consider them.

Siegel's premise is that commercial Web design is an exciting and noble undertaking, but one that is fraught with pitfalls. His goal is to help both designers and their clients understand what they are getting into, what each side needs to bring to the table, and what both sides must do to communicate effectively. He also addresses the practical realities that make or break a project, figuring out what a particular Web site is supposed to do, how long will it take to build, what it will cost, and how it will be maintained.

The first half of the book consists of case studies of the creation--often painful--of successful Web sites. The hurdles these developers faced include hopelessly unrealistic schedules, flaky subcontractors, confused clients, and the immaturity of Web technology itself. Each study showcases the particular problems that the designers faced, how they managed to overcome them, and how you can avoid finding yourself in the same spot. The second half of the book is a systematic exposition of the ropes: What the market realities are, how designers and clients find each other, how to put together a proposal and bid on a job, and how to manage a project using Web technology. Siegel also takes you through the creation of content and design, staffing the fledgling site, testing it, and finally getting it online.

Organizational nitty-gritty of this sort is the less glamorous side of building a site, but Siegel injects it with the same excitement that made his Creating Killer Web Sites a smash bestseller. Anyone involved in creating a real Web site will find excellent practical orientation and a lot of much-needed debunking in Secrets of Successful Web Sites....
